When Chuck McDowell began to realize all that was used to get innocent consumers to buy into these scams, he decided to leave the timeshare industry for good. Won’t Back Down: The Wesley Financial Group Lawsuit
After Chuck McDowell began helping out individuals who were dealing with timeshare fraud, he was slammed with a lawsuit by Wyndham. Wyndham alleged that he had shared trade secrets and attached multiple causes of action against him in the lawsuit. These included violations of the Tennessee Uniform Trade Secrets Act, unauthorized practice of law, intentional interference with business relations, civil conspiracy, breach of contract, unfair competition, procurement of breach of contract, violation of the Tennessee Consumer Protection Act and unjust enrichment. You could almost say that everything was alleged but the “kitchen sink”. This “kitchen sink” pleading wouldn’t stand with the jury.
Now, Chuck McDowell could have settled. He could have thrown up his hands in fear, but he knew what was right. Instead, the case went through a jury trial. Within 20 minutes, the jury ruled in favor of Chuck McDowell on all counts. The US District Judge in the Middle District of Tennessee took further action by dismissing the case with prejudice. This means that the case cannot be brought back to court on the same claims. Furthermore, as Attorney Lyndsay Smith Hyde of McKellar Hyde law firm stated, “The fact that the jury returned a verdict so quickly makes it clear that the lawsuit was without merit.”Attorney Lyndsay Smith and her partner Andrea McKellar represented Chuck McDowell in the lawsuit.
